Frequently Asked Questions
Q: Does Nicole Peck McPhee offer virtual consultations?
A: Yes. Nicole offers secure virtual consultations via Google Meet and an online client portal for clients throughout Vermont. You can schedule, consult, and complete your legal matter entirely online if preferred.
Q: What areas of Vermont does Nicole Peck McPhee serve?
A: Nicole serves clients statewide, with a primary office in Rutland. She regularly serves clients in Rutland County, Addison Cunty, Windsor County, and Bennington County, and is available to clients in all 14 Vermont counties via virtual consultation.
Q: How much does an estate plan cost in Vermont?
A: The cost depends on the complexity of your situation. A basic will and power of attorney package differs from a full trust-based plan with tax planning. Nicole provides clear fee information during the initial consultation to avoid surprises.
Q: Do I need a lawyer for a real estate closing in Vermont?
A: Vermont does not legally require attorney representation at a closing, but it is strongly advisable. A real estate attorney reviews the title, identifies encumbrances, prepares closing documents, and protects your interests in ways a real estate agent or title company cannot.
Q: What is the difference between a will and a living trust in Vermont?
A: A will takes effect at death and must pass through the Vermont probate court. A living trust takes effect during your lifetime, avoids probate, and can also manage your affairs if you become incapacitated. Many Vermont residents benefit from having both.
Q: How do I start a Vermont LLC?
A: Forming a Vermont LLC requires filing Articles of Organization with the Vermont Secretary of State, drafting a comprehensive operating agreement, and meeting initial compliance requirements. Nicole handles the full formation process and helps you structure the LLC to meet your business and personal goals.
Q: Can I handle a Vermont adoption privately without going through an agency?
A: Yes. Vermont allows private (non-agency) adoptions. Nicole represents both biological and adoptive parents in private placements, handling all required legal documentation, consent proceedings, and court filings through to finalization.
Q: How long does Vermont probate take?
A: Vermont probate typically takes 9 months to over a year, depending on the size and complexity of the estate, any disputes among heirs, and tax obligations. Nicole works efficiently to move the process forward and keeps families informed throughout.
